These terms apply from 14 September 2026.
These terms are a translation of the Polish Regulamin sklepu. If the two differ, the Polish text prevails.
§ 1. General provisions
- The ParkApp online shop, available at sklep.parkapp.pl, is run by ParkApp Sp. z o.o., registered office: Człuchowska 13, 85-808 Bydgoszcz, entered in the register of entrepreneurs of the National Court Register kept by Sąd Rejonowy w Bydgoszczy, XIII Wydział Gospodarczy KRS under KRS number 0001095079, tax ID (NIP) 9532802621, REGON 528121812, share capital 5 000 zł. E-mail: wlasciciel@parkapp.pl, telephone: +48 518 518 800.
- These terms set out the rules for using the shop, placing orders, concluding sales contracts, making payments, delivery, withdrawal from the contract and complaints.
- The shop sells only within the Republic of Poland.
§ 2. Definitions
- Seller – ParkApp Sp. z o.o., which runs the shop.
- Customer – a natural person, legal person or organisational unit placing an order.
- Consumer – a natural person carrying out a legal transaction with the Seller that is not directly connected with their business or professional activity.
- Sole trader with consumer rights – a natural person concluding a contract directly connected with their business activity, where the content of the contract shows that it is not of a professional nature for them, arising in particular from the subject of their business activity as disclosed under the rules of the Central Register and Information on Economic Activity (CEIDG).
- Product – a movable item offered in the shop.
- Personalised Product – a Product made to the Customer's specification or to meet their individual needs, in particular a sign or banner prepared for a parking or spots the Customer has indicated. Personalised Products are marked as such on the Product page.
- Account – the Customer's account in the shop, shared with their ParkApp app account.
- Sales Contract – a distance contract concluded between the Customer and the Seller.
- Terms – this document.
§ 3. Account and placing orders
- Orders can be placed 24 hours a day, 7 days a week.
- An Account is needed to place an order. The Customer signs in with an e-mail address, to which the Seller sends a one-time code.
- Placing an order consists of:
- choosing a Product and its variant and adding it to the basket – for Products prepared for a parking or its spots, also indicating that parking or those spots;
- giving the orderer's details, the invoice details and the delivery address;
- confirming the order with the “Order and pay” button;
- paying through the Paynow system.
- The Sales Contract is concluded when the Seller confirms that the order was accepted.
- The proof of purchase is a VAT invoice, which the Seller issues for every order and sends electronically (as a PDF file) to the e-mail address given in the order.
§ 4. Prices and payment
- Product prices are given in Polish zloty and include VAT.
- Delivery is free, so the amount in the order summary is the total amount.
- Payments are handled by the Paynow system. After placing the order, the Customer is redirected to the Paynow page, where they choose one of these payment methods:
- BLIK;
- a fast online bank transfer;
- a payment card: Visa, Visa Electron, Mastercard, MasterCard Electronic or Maestro;
- Apple Pay or Google Pay.
- Online payments are provided by mElements S.A.
- Orders are paid for in advance.
- If an order is not paid within 3 working days, the Seller may cancel it.
- The shop may offer promotions and discounts – their rules are described on the shop's pages.
§ 5. Delivery
- Products are delivered by courier companies to the address given in the order.
- Delivery is free.
- The order processing time is counted from the moment the payment is credited, whichever payment method was used, and is usually:
- for ready-made Products – up to 3 working days;
- for Personalised Products – up to 7 working days from the approval of the design, but not earlier than from the moment the payment is credited.
- Delivery by the carrier usually takes 1–2 working days.
- The Seller asks the Customer to check the condition of the parcel on receipt and, if it is damaged, to draw up a damage report with the courier. This is not a condition for exercising the rights described in § 6 and § 7.
§ 6. Withdrawal from the contract
- A Consumer may withdraw from the Sales Contract within 14 days of receiving the Product, without giving a reason.
- The right of withdrawal does not apply to Personalised Products (Article 38(1)(3) of the Polish Consumer Rights Act).
- To withdraw, it is enough to send a statement to wlasciciel@parkapp.pl before the deadline. The Consumer may use the model withdrawal form set out in Annex 2 to the Polish Consumer Rights Act, but does not have to.
- The Consumer sends the Product back to the address given by the Seller within 14 days of withdrawing from the contract and bears the direct cost of returning it.
- The Seller refunds all payments made by the Consumer without delay and no later than 14 days after receiving the withdrawal statement, using the same payment method the Consumer used. The Seller may withhold the refund until it has received the Product back or proof that it was sent.
- If the order was paid by payment card, including through Apple Pay or Google Pay, the refund is made to the account of the card used for the payment.
§ 7. Complaints
- The Seller is obliged to deliver a Product that conforms with the contract.
- The Seller is liable for any lack of conformity of the Product with the contract that existed when it was delivered and becomes apparent within 2 years of that time.
- A complaint can be made:
- by e-mail to wlasciciel@parkapp.pl;
- in writing to the Seller's registered office: Człuchowska 13, 85-808 Bydgoszcz.
- A complaint should include the Customer's details, the order number, a description of the defect, photographs where possible, and the expected resolution: repair, replacement, a price reduction or withdrawal from the contract.
- The Seller responds to a complaint within 14 days of receiving it.
§ 8. Personal data
How Customers' personal data is processed is described in the privacy policy (in Polish).
§ 9. Final provisions
- These Terms are available on the shop's website.
- Sales Contracts are concluded in Polish.
- The Seller and the Customer seek to settle disputes amicably. A Consumer may use out-of-court complaint and redress procedures, in particular the help of a municipal or district consumer ombudsman or a provincial inspectorate of the Trade Inspection. Information about these procedures is available at uokik.gov.pl.
- Disputes that cannot be settled amicably are resolved by the competent civil court.
- The provisions of these Terms concerning the Consumer's right of withdrawal and complaints also apply to a Sole trader with consumer rights.
- Matters not covered by these Terms are governed by the Polish Civil Code and the Polish Consumer Rights Act of 30 May 2014.
- The Seller may change these Terms. Changes apply from their publication on the shop's website and do not affect orders placed before then.
